Medical Device Malfunctions
We are lucky enough to live in a time when there are many FDA-approved medical devices that are designed to improve or extend our lives. However, when those medical devices malfunction, the results can be devastating.

While any medical device can malfunction, defibrillators and pacemakers are of special concern. A defibrillator is a device that provides an electronic charge to the heart to restart a normal heartbeat, while a pacemaker keeps the heart on a steady rhythm. Like any machine, defibrillators can malfunction. Almost a quarter of a million defibrillators and pacemakers have been recalled since 2005.
Guidant Corporation recalled 50,000 cardiac defibrillators and pacemakers due to an internal short-circuit that could cause the devices to fail to deliver an electrical shock to the heart when it was needed. Medtronic Inc., the manufacturer of the Sprint Fidelis Implantable Cardiac Lead Device, recalled certain models because of defective leads that could cause the devices to deliver inappropriate shocks to patients. Medtronic Inc. also recalled more than 80,000 other defibrillators due to a battery malfunction that could cause a harmful loss of power.
You May be Entitled to Damages When a Medical Device Malfunctions
If a malfunctioning medical device has hurt you or a loved one, you may file a lawsuit against the person or company responsible for the malfunction. If, for example, your injury occurred because of a design or manufacturing defect, you may be able to file a products liability lawsuit against the manufacturer of the device. If the injuries were caused because a doctor incorrectly installed a medical device, or did not advise you on the proper maintenance or limitations associated with the device, you may have a medical malpractice claim against the doctor.
It can be difficult and overwhelming to figure out who is responsible for the medical device malfunction. More than one defendant may be liable for the harm you've suffered. In order to recover damages, it is important that you bring your lawsuit against the parties that are legally responsible. A firm of experienced attorneys who have handled diverse product liability and medical malpractice cases can identify those parties and file the correct lawsuit(s) on your behalf.
The experienced litigators of Schwartzapfel Partners P.C. are qualified to represent you if a medical device that malfunctioned has hurt you or a loved one.
